3.1 Account Creation
To use the Service, you must create an account by providing accurate, complete information. You are responsible for:
Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access

You may not:
Create multiple accounts to circumvent limitations
Share your account with others
Use another person's account without permission
Create accounts through automated means or false pretenses
4. Subscription Plans and Billing
4.1 Free Trial
We offer a 14-day free trial with full access to features. No credit card is required for the trial. The trial automatically ends after 14 days unless you subscribe to a paid plan.
4.2 Paid Subscriptions
After the trial, you may subscribe to a paid plan:
Starter: $6/month (or $5/month annually)
Growth: $18/month (or $15/month annually)
Pro: $48/month (or $40/month annually)
4.3 Payment Processing
Payments are processed through third-party payment processors based on your location:
Global: Stripe (credit/debit cards, Apple Pay, Google Pay, PayPal)
India: Razorpay (UPI, Paytm, Net Banking, cards)
You authorize us to charge your selected payment method on a recurring basis according to your billing cycle.
4.4 Usage Limits
Each plan includes a monthly limit of AI-generated replies. If you exceed your limit:
Automatic replies will pause until your next billing cycle
You can manually reply to customers at any time
You can purchase top-ups: $4 for 100 replies, $14 for 500 replies
4.5 Billing Cycle
Monthly: Billed on the same day each month
Annual: Billed once per year with 17% savings
4.6 Price Changes
We may change our pricing with 30 days' notice. Changes will not affect your current billing cycle.
5. Cancellation and Refunds
5.1 Cancellation
You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of your current billing period. You will retain access until then.
5.2 Refunds
We offer refunds under the following conditions:
Within 7 days of first payment: Full refund if the Service does not meet your expectations
Service outages: Pro-rated credit for documented extended downtime
Billing errors: Full refund for incorrect charges
Refunds are not available for:
Partial billing periods
Unused features or reply limits
Change of mind after 7-day refund period
6. Acceptable Use

You may use the Service only for lawful purposes and in accordance with these Terms. You are responsible for all content processed through the Service.

When you upload conversations for AI voice training:
Data is used only to train your specific AI instance
Conversations are encrypted and stored securely
We do not share your training data with other users
AI models may use anonymized patterns to improve accuracy (opt-out available)
9. Service Availability
We strive for 99.9% uptime but cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to:
Scheduled maintenance (with advance notice)
Emergency maintenance or security updates
Third-party service disruptions
Force majeure events
10. Data Security and Backups
We implement industry-standard security measures, but you are responsible for:
Maintaining secure account credentials
Backing up critical business data independently
Monitoring your account for unauthorized activity
11. Termination
11.1 Termination by You
You may terminate your account at any time by canceling your subscription and deleting your account through the dashboard.
11.2 Termination by Us
We may suspend or terminate your account if you:

Merchantability or fitness for a particular purpose
Accuracy, reliability, or completeness of AI-generated responses
Uninterrupted or error-free operation
Security against unauthorized access
YOU ARE RESPONSIBLE FOR REVIEWING ALL AI-GENERATED RESPONSES BEFORE THEY ARE SENT TO CUSTOMERS.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CORTEX SYSTEMS SHALL NOT BE LIABLE FOR:
Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Damages arising from AI errors or inappropriate responses
Third-party actions or content
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.
14. Indemnification
You agree to indemnify and hold harmless Cortex Systems from any claims, damages, losses, or expenses arising from:
Your use of the Service
Your violation of these Terms
Your violation of any laws or third-party rights
Content you upload or messages sent through the Service
15. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.
16. Governing Law
These Terms are governed by the laws of the jurisdiction in which Cortex Systems is registered, without regard to conflict of law principles.
17. Dispute Resolution
Any disputes arising from these Terms or the Service shall be resolved through:

18.2 Severability
If any provision is found unenforceable, the remaining provisions remain in effect.

Failure to enforce any right or provision does not constitute a waiver of such right or provision.
